A federal judge ordered the Trump administration on Friday to release Mahmoud Khalil, a student at Columbia University who became leader of campus protests in favor of Palestinian, AFP said.
Khalil, a legal permanent resident of the US who is married to a US citizen and has a son born in the US, has been in custody since March facing possible expulsion.
Regional Judge Michael Farbiarz ordered Khalil’s release with a guarantee during listening on Friday and will be allowed to return to New York while his deportation is proceeding.
“After more than three months, we can finally breathe a sigh and know that Mahmoud is on his way home,” said his wife, dentist Noor Abdalla born in Michigan.
“We know that this decision is not beginning to deal with the injustices that Trump’s administration has brought to our family, and so many others are trying to silence to speak against the ongoing Israeli genocide against the Palestinians,” he added.
Amol Sinha, executive director of the American Union of Civil Liberties of New Jersey, who is one of the teams representing Khalil, welcomed the liberation order.
“This is an important step towards Mr Khalil’s rights to score, as he still is still aiming for the federal government to defend Palestinian rights,” Sinha said. “We are sure that he will eventually prevail in the struggle for his freedom.”
Since his arrest on March 8th by immigration agents and customs enforcement, Khalil has become a symbol of President Donald Trump’s campaign to stifle the pre-palestinian activism of students against the Gaza War in the name of restriction.
At that time a postgraduate student at the University of Columbia in New York, Khalil was one of the most visible leaders in the National Campus Campus against Israeli war in Gaza.
Following his arrest, the US authorities transferred Khalil, who was born in Syria to Palestinian parents, nearly 2,000 kilometers (1,242 miles) from his home in New York in a detention center in Louisiana, pending deportation.
Foreign Minister Marco Rubio has cited a law approved during the 1950s red terrorism, which allows the United States to remove foreigners who are considered adverse in US foreign policy.
Rubio argues that US constitutional protections do not apply to foreigners and that only can he make decisions without a judicial review.
Hundreds of students have seen their visas being recalled, with some saying that they aim for everything, from drawing up opinion articles to small arrest files.
