A federal appeal court on Friday revived a part of a trial accusing Elon Musk’s X to take refuge for children, although the court said the platform was worth wide immunity from claims about unacceptable content, Reuters said.
While some claims are rejected, the 9th US Court of Appeal in San Francisco said X, former Twitter, must face a claim that it was negligent, failing to immediately mention a video containing explicit images of two minor boys at the National Center for Missing Children (NCMC).
The case preceded the Twitter Musk 2022 market. A judge in the trial had rejected the case in December 2023. X lawyers did not immediately respond to requests for comments. Musk was not a defendant.
A plaintiff, John Doe 1, said he was 13 years old when he and a friend, John Doe 2, were enticed to Snapchat in providing nude photos of themselves to someone that John Doe 1 thought he was a 16 -year -old girl in his school.
The user of Snapchat was actually a children’s pornographic trafficker who blackmailed the plaintiff to provide additional explicit photos. These images were later drawn up in a video posted on Twitter.
According to court documents, Twitter took nine days after learning about the content to download it and report it to NCMEC, after more than 167,000 views, the court documents showed.
Judge Danielle Forrests said that Article 230 of the Federal Communications Act, which protects electronic platforms from the content of users’ content, was not exercised by the requirement of negligence as soon as he learned about pornography.
“The events that claim here, coupled with the mandatory requirement of ‘real knowledge’, separates the task of reporting child pornography in NCMEC from the role of Twitter as a publisher,” he wrote for a group of three judges.
The X must also face a claim that its infrastructure has made it very difficult to mention child pornography.
It was found immune by allegations that she was aware of sex with sex trafficking and created a search features that “boost” child pornography posts.
Dani Pinter, a lawyer at the National Sexual Center, who represented the plaintiffs, said in a statement: “We look forward to the discovery and ultimately the trial against X to obtain justice and accountability.”
The case is DOE 1 et al v Twitter Inc et al, 9th US Circuit Court of Appeal, No 24-177.
