The US Supreme Court has granted a temporary depreciation to Trump’s administration by blocking the mandate of the lower court that required a Salvador departed man to return to the United States, Reuters reported.
Justice chief John Roberts approved the request to stop the decision, which had been ordered by Kilmar Abrego Garcia to be returned at 11:59 pm Monday.
Mr Garcia was deported on March 15, with the government initially reporting a “administrative mistake” for his removal. However, he also claims to be a member of the MS-13 gang, a category that denied his legal team.
In his appeal to the Supreme Court, the Administration argued that the regional judge had overcome its power and that it was not within the US government’s power to force El Salvador to comply.
“The United States does not control El Salvador’s sovereign nation, nor can El Salvador be forced to follow the offer of a federal judge,” wrote Attorney General D John Sauer.
He added: “The Constitution charges the President, not the federal regional courts, by conducting foreign diplomacy and the protection of the nation by foreign terrorists, including invoking their removal.”
Mr Garcia is currently being held at the Elvador Terrorist Center, known as Cecot. His wife, American citizen Jennifer Vasquez Sura, called for his release.
The 29 -year -old entered the US as a teenager and had previously been granted protection from expulsion in 2019.
Last week, Judge Paula Xinis ruled that Mr Garcia was held “without a legal basis” and the government acted “without legal power”.
The lawyer of the Justice Ministry Erez Reuveni, who had admitted that Mr Garcia “should not have been abolished”, was put on administrative leave, according to US Attorney Pam Bondi.
The Supreme Court intervened just a few hours before the return deadline, which officials had described as “impossible”.
