  • Trump probably acted in the context of power, says the US Court of Justice.
  • Newsom can question the use of the National Guard in accordance with other laws.
  • “The president is not a king and he is not above the law,” says the California governor.

A United States Court of Appeal allows Donald Trump to maintain control on Thursday for the California National Guard, while the Democratic Governor of the State is proceeding with a lawsuit that challenges the use of troops by the Republican president to eliminate protests in Los.

Trump’s decision to send troops to Los Angeles caused a national debate on the use of the army on US territory and committed political tension in the country’s second most intellectual city.

On Thursday, a committee of three courts of the 9th US Court of Appeal, based in San Francisco, expanded its cessation to US Regional Judge Charles Breyer on June 12 that Trump had illegally invited the National Guard to the Federal Service.

Trump probably acted in his power, the committee said, adding that his administration probably complied with the demand to coordinate with Governor Gavin Newsom and even if he did not, he had no power in Veto Trump’s directive.

“And although we believe that the president is likely to have the power to federal in the National Guard, nothing in our decision addresses the nature of the activities in which the federal national guard can deal with,” he wrote in her opinion.

Newsom could still question the use of the National Guard and US Marines in accordance with other laws, including the use of troops on domestic law enforcement, he added.

The commander could raise these issues during the court hearing on Friday in front of Breyer, he said.

In a post on X after the decision, Newsom pledged to continue his challenge.

“The president is not a king and he is not above the law,” he said. “We will promote our challenge to the authoritarian use of US soldiers by President Trump against our citizens.”

Trump welcomed the decision in a position in the truth of the social.

“This is a great decision for our country and we will continue to protect and defend Americans who adhere to the law,” he said.

“This is much greater than Gavin, because in all the United States, if our cities and people need protection, we are the ones who give them to those who should be kept and local police incapable, for whatever reason, to do the job.”

Breyer’s decision was filed against Trump’s action brought by Newsom.

Breyer ruled that Trump had violated an American law that governs the ability of a president to take control of a state’s national guard, failing to coordinate with the governor.

He also found that the terms set out in the context of the Articles of Association to allow this movement, such as an uprising against federal power, did not exist.

Breyer ordered Trump to return control of the California National Guard to Newsom. Hours after Breyer was informed, the 9th circuit table had temporarily put the judge’s movement. In the midst of protests and turmoil in Los Angeles on Trump’s immigration raids, the president on June 7 took control of the California National Guard and developed 4,000 troops against Newsom’s desires.

Trump also ordered 700 US Marines in the city after the National Guard was missed. Breyer has not yet ruled on the legality of the mobilization of the marine body.

At the court hearing on Tuesday on whether the Breyer ruling will be expanded, members of the 9th circuit table challenged lawyers on California and Trump’s administration on the role, if any, the courts would have to revise Trump’s power.

The law sets out three conditions by which a President can federal forces of the National Guard, including the invasion, a “uprising or danger” against the government or a situation in which the US government cannot execute its normal forces.

The Court of Appeal stated that the final situation was probably satisfied because the protesters threw objects into the vehicles of the migration authorities, used rubbish, such as thieves, threw Molotov cocktails and vandalized real estate, frustrating law.

The Ministry of Justice said when the president finds out that there is an emergency that justifies the use of the National Guard, no court or ruler of the state can revise this decision. The Court of Appeal rejected this argument.

Protests in Los Angeles ran for more than a week before they took out, leading Los Angeles Mayor Karen Bass to raise a ban on the traffic.

In its lawsuit on June 9, California stated that the development of the National Guard and the Navy violated the sovereignty of the state and US laws that banned the federal troops from participating in the law of civil law.

Trump’s administration has denied that the troops were involved in law enforcement, saying they were protecting federal buildings and staff, including US immigration and customs officers.

The 9th circuit table consists of two judges appointed by Trump during his first term and one appointed democratic former President Joe Biden.
