Tech billionaire and Tesla CEO Elon Musk hit out at a battery maker in India on Friday that was using the carmaker’s name for its marketing purposes.
The Indian company was under the brand name Tesla Power and the case has been filed in New Delhi Reuters.
During the hearing in the Indian capital, the Texas-based electric vehicle maker said the Indian company continued to advertise its products under the “Tesla Power” brand despite a cease and desist notice sent in April 2022, according to the proceedings published on the website of the Supreme Court.
Tesla Power India Pvt Ltd has argued that its primary business is to manufacture “lead acid batteries with no intention of manufacturing electric vehicles.
The Indian company was given a period of three weeks to submit written responses after its defence.
The 52-year-old billionaire’s company is incorporated in Delaware and accused the Indian company of using trade names ‘Tesla Power’ and ‘Tesla Power USA’.
The agency said: “The court record included screenshots of a website showing that Tesla Power USA LLC was also headquartered in Delaware and was recognized as a pioneer and leader in importing affordable batteries with a very strong presence in India.”
A Tesla Power spokesperson Manoj Pahwa told the publication, “It was present in India long before Musk’s Tesla and had all government approvals. We have never claimed to be related to Elon Musk’s Tesla.”
Musk’s company said the Indian company was using its trademark in 2022 and tried to stop it, but could not.
The case was filed days after Elon Musk canceled his April 21 visit to the nuclear-armed nation to meet Prime Minister Narendra Modi.
