Former Trump lawyer admits to using AI-generated legal cases in court

Michael Cohen Says He Mistakenly Thought Google Bard Was An ‘Overloaded Search Engine’ Unlike ChatGPT

Michael Cohen, the former personal attorney to US President Donald Trump, is sworn in to testify before a House Oversight and Reform Committee hearing on Capitol Hill in Washington, US, February 27, 2019.

Michael Cohen, the personal lawyer of former United States President Donald Trump, has admitted to using Google’s artificial intelligence chatbot Bard to mistakenly mention fake legal cases in a court filing.

The fabricated pleas were used to secure an early end to judicial supervision, allowing Cohen to be released in 2021, according to Worthy.

Cohen argued in a motion in November that he had served prison time and complied with the terms of his release. However, a federal judge disputed the three case citations used in the motion, stating that “as far as the Court can tell, none of these cases exist.”

The judge ordered Cohen’s attorney to provide copies of the three rulings or explain their reference and Cohen’s role in the motion.

Cohen’s attorney, Dania Perry, disclosed that he used Google Bard for “open source research” in his motion, but his attorney, David Schwartz, included the case references in the lawsuit without verifying them, according to an unsealed court filing .

Schwartz acknowledged in a court letter that he had not thoroughly checked the reports, adding that he believed the reports came from Perry and would have looked into them if he had known they came from Cohen. ABC News mentionted.

Cohen, a non-practicing attorney, admitted to not keeping up with the trends and risks of legal technology, saying he mistakenly thought Google Bard was an “overloaded search engine” and didn’t realize it could generate fake reports, similar to ChatGPT.

“It didn’t occur to me then — and it’s surprising to me now — that Mr. Schwartz would drop the cases in his deposition wholesale without even confirming they existed,” Cohen added.

This is not the first case to highlight the dangers of using artificial intelligence for legal research.

Two New York lawyers were sanctioned earlier this year for filing a legal brief alleging six false cases created by ChatGPT in a lawsuit against airline Avianca.

In an affidavit, one of the lawyers admitted to using ChatGPT for research, but expressed “deep regret” for his actions.
