- The powers of arrest already mentioned in the sales tax law, 1990.
- The proposed modifications limit the powers of arrest to a previous survey.
- CIR to authorize only arrest in the findings of the relevant detectors.
Islamabad: The Federal Revenue Council (FBR) assured that there were relevant safeguards to avoid abuse of arresting powers in the proposed funding bill 2025-26, The news reported on Sunday.
In a statement, the FBR recently pointed out various news on digital and printing media indicating that some of the amendments introduced into the bill were not well understood by the general public, including the legal provisions for the arrest of those involved in tax fraud.
These provisions have already been provided for in accordance with Article 37A of the Sales Act, 1990, along with a complex procedure that must be followed after the arrest involving the immediate submission of the Special Judge and the production of such a person before the judge within 24 hours.
However, the proposed amendments are now limiting the powers of an officer to arrest, conducting a previous investigation after the approval of the CIR Commissioner (CIR). Only on the basis of the findings of the investigation, the CIR will allow the investigation that would give the investigation into the powers of an official responsible for a police station in accordance with the Criminal Procedure Code, 1898 (Act V of 1898).
The arrest can only be done with the prior approval of the CIR if the investigator has reason to believe that tax fraud has been committed by one person.
The new legal provision further predicts that if the arrest is Mala Fide, the matter will be referred to the Chief Commissioner for an investigation of events. This shows that, unlike the previous provision where a Cir assistant could capture a perpetrator, the new provisions bring transparency into the process through compulsory previous research and research and final permission from the CIR.
In addition, some changes are also necessary to reassure the compliant taxpayers that these taxes that avoid or are involved in tax fraud are treated by the state with iron hand. FBR President Rashid Mahmood Langrial expressed the willingness to discuss the recent changes made to tax laws and to introduce changes where, for example, the provisions associated with an arrest could be revised to enforce the permission of many senior officers before any arrest.
In addition, to ensure that these powers are not used by the authorized tax officials against compliance taxpayers and the business community, Prime Minister Shehbaz Sharif has set up a high -power committee, which will be directed by the Minister of Finance to evaluate the proposed modifications to powers.
The other members of the Commission will include ministers of legal and financial affairs, Minister of Finance, SAPM for industries and heads of FBR.
The Commission will also consider various options to ensure that legal economic activities are not stifled and propose additional protective measures against the illegal use of power and will submit its recommendations to the Prime Minister in three days.
The FBR is committed to protecting the legal rights of compliant taxpayers and increasing the collection of taxes and state revenue, discouraging non -compliant taxpayers and recognizing those who pay their debt due to the state.
It should be noted that Prime Minister Shehbaz has set out six pre -existing conditions for the integration of the arrests of CEOs, CFOs and the Board of Directors.
- If a person involved in tax fraud tries to escape.
- He tries to violate the evidence.
- Three notifications were issued for a summons but did not appear.
- A certain limit of tax fraud;
- Tax fraud of 50 million Rs for the arrest of executives;
- It was approved by the FBB’s Special Board of Directors together with the representative of the private member probably by the Chamber of Commerce for arrests.
In addition, the Senate Finance Committee has asked FBR to determine a threshold and establish plates to allow tax fraud to be arrested and up to ten years in prison under the proposed funding bill 2025-26.
The tax tax organization suggested that there should be a limit of 10 million Rs to allow arrest.
