ISLAMABAD: The Supreme Court (SC) on Monday accepted review petitions filed by Justice Qazi Faez Isa and his wife Sarina Isa.
A 10-member full court bench headed by Justice Umar Ata Bandial heard the case.
The majority decision from the top court said that no action could be taken against the wife and children of Justice Qazi Faez Isa after the apex court withdrew its direction to send Sarina Isa’s case to the FBR.
The bench accepted Justice Isa’s petition by a majority vote of 6-4. Justices Bandial, Sajjad Ali Shah, Munib Akhtar and Qazi Amin disagreed with the decision.
While the judges who accepted the petitions against the top court’s June 2020 order include, Justice Yahya Afridi, Justice Maqbool Baqar, Justice Mazhar Alam Miankhel, Justice Manzoor Ahmed Malik, Justice Aminuddin Khan and Justice Yahya Afridi.
Justice Yahya Afridi also wrote a dissenting note.
The court declared legal actions taken by the Federal Board of Revenue (FBR) and all other forums related to the assets of Justice Isa’s wife and children as “illegal”.
The judgement stated that the FBR’s report could not be challenged in the Supreme Judicial Council (SJC) or any other legal forum.
The bench earlier today reserved the verdict after all parties to the case concluded their arguments.
Previously, the Supreme Court judge and his wife had challenged the apex court’s order on the presidential reference seeking the removal of Justice Isa for failing to disclose foreign properties of his family members.
