Harvard wins the expansion of the court ruling that prevents the international ban on Trump students

A federal judge said on Monday that he would issue a brief expansion of an order that temporarily prevents President Donald Trump’s plan from preventing foreigners from entering the US to study at Harvard University, while deciding whether to issue a long -term order.

US Regional Judge Allison Burroughs, at the end of a hearing in Boston at Harvard’s legal challenge on restrictions, expanded on June 23 a temporary retention order set to end on Thursday. She said she wanted to give herself more time to prepare a decision.

“We will start an opinion as soon as possible,” he said.

The judge plans the hearing after issuing a temporary restraint mandate on June 5, preventing the administration from implementing a declaration that Trump had signed a day earlier. A preliminary order will provide long -term relief to Harvard, while its lawsuits are moving.

Nearly 6,800 international students attended Harvard in the latest school year, accounting for about 27% of the student population of the famous Cambridge school, based in Massachusetts.

The judge, an appointed democratic President Barack Obama, did not show how he would eventually rule. However, he said that a US justice ministry lawyer defending Trump’s policy had faced a “uphill battle” that convinces her that Harvard would not hurt irreparably if the declaration was implemented.

Ian Gershengorn, a school lawyer, told the judge that “the impact of the declaration is catastrophic for Harvard and his students”.

He said Trump signed the Declaration to oppose Harvard in violation of the rights of Liberty of speech in accordance with the first amendment of the US Constitution to refuse to join the administration’s demands to control the governance of the school, the curriculum and its ideology.

Justice ministry lawyer Tiberius Davis faced that Congress had given Trump “sweeping power” in accordance with the law on immigration and nationality to suspend the entry of specific aliens, in which the president relied on the confrontation.

“We do not trust them to accommodate foreign students,” Davis said.

Trump’s administration launched a multi -level attack on the oldest and richer American university, freezing billions of dollars on grants and other funding and proposing to terminate tax exemption regime, causing a number of legal challenges.

Harvard has filed two separate lawsuits before Burroughs seeks to exceed about $ 2.5 billion in funding and to prevent administration from preventing international students from attending university.

Internal Security Secretary Kristi Noem on May 22 announced that its department immediately lit the certification of the Harvard Student Program and the exchange of visitors, the government mechanism that allows it to register foreign students.

Her action was almost immediately blocked by Burroughs. While the Ministry of Interior has since shifted to Harvard’s provocative certification through an administrative process, Burroughs on a hearing of May 29 said it was planning to issue a “wide” order to maintain the status quo.

A week later, however, Trump signed his proclamation, which reported concerns about national security to argue that Harvard is “no longer a reliable manager of international visitors and exchanges”.

The Declaration suspended aliens entry to study at Harvard or participate in visitors programs for an initial six -month period and directed Foreign Minister Marco Rubio to examine whether they would recall international students who have already enrolled in Harvard.

At Monday’s hearing, Davis reported Harvard’s acceptance of foreign money, including China and what he said was an inadequate response to the demand for information on foreign students who were involved in illegal activity during a period of “increased” periods.

Trump accused Harvard of creating an unsafe environment for Jewish students and allowing anti -Semitism to be seduced into his campus. Protests about Israel’s treatment for Palestinians during the war with Hamas in Gaza have wandered through numerous campuses, including Harvard.
